Terms of Service — A.L.I.C.E.

Provider. A.L.I.C.E. is a brand-protection and IP monitoring service. By engaging A.L.I.C.E.’s services, the client ("Client") agrees to these Terms of Service ("Terms"). A.L.I.C.E. provides investigative monitoring services — combining automated scanning where permitted with manual analyst verification — to identify potential unauthorized uses of Client brand assets on public platforms. A.L.I.C.E. strictly complies with each platform’s Terms of Service and accesses only public content, content accessible to standard free-user accounts (accounts any member of the public can freely create), or content accessible via Client-provided credentials. All findings and evidence are reviewed and verified by a dedicated investigator. The Services are informational only: A.L.I.C.E. does not provide legal advice, does not guarantee enforcement outcomes, and does not perform takedown actions unless explicitly contracted to do so.


1. Scope of Services

Monitoring and Reporting. A.L.I.C.E. monitors agreed platforms for potential unauthorized uses of Client brand assets and manually verifies each relevant finding. Reports include an executive summary, a structured evidence table (URLs, screenshots, UTC timestamps, metadata, and identifiers), analysis of infringer behavior (including repeat infringers), informational impact estimates, and suggested non-legal next steps. All evidence capture is passive: the investigator does not message, contact, purchase from, or otherwise interact with suspected infringers.

Evidence Handling. Reports are accompanied by chain-of-custody documentation and a Signed Evidence Verification Statement. For each captured file, A.L.I.C.E. records capture method, UTC timestamp, and computes a SHA-256 hash of the raw file to ensure integrity. Media files are delivered in their original form and not altered prior to hashing. Evidence is stored and transferred using strong encryption and documented custody steps.

Limitations & Exclusions. A.L.I.C.E. examines only publicly available content, content accessible to standard free-user accounts (where permitted), and content accessible to the investigator using Client-provided credentials. A.L.I.C.E. does not access private accounts, private messages, encrypted or private datasets, or any content behind unauthorized logins. A.L.I.C.E. will not engage in hacking, bypassing authentication, exploiting vulnerabilities, or any activity that would violate a platform’s Terms of Service or applicable law. Automated scanning is used only where explicitly permitted by a platform’s Terms; otherwise all monitoring is performed manually. A.L.I.C.E. does not provide legal opinions or legal determinations and will not perform takedown or enforcement actions unless explicitly contracted and authorized to do so.

Optional Evidence Add-Ons. Special evidence packages (such as 3D captures/models or expanded profiling packages) may be provided by separate agreement and will be included in the engagement quote when applicable.


2. Client Obligations and Permissions

Access and Credentials. The Client must provide any credentials or access permissions required for content the Client is entitled to access. Where permitted by platform Terms, A.L.I.C.E. may create standard free-user accounts (accounts anyone can freely create) to view public or ordinarily accessible content; such accounts will not be used to circumvent restrictions or access prohibited content.

Lawful Instructions. The Client represents and warrants that all instructions, credentials, and materials provided to A.L.I.C.E. are lawful and that the Client has the right to request the Services. The Client must not request actions requiring A.L.I.C.E. to breach platform Terms of Service or applicable law.

Use of Evidence. The Client agrees to use all reports and evidence lawfully. Evidence is provided for internal review or sharing with legal counsel. The Client remains responsible for independently verifying findings and for all decisions or enforcement actions taken using the evidence.

Confidentiality. Both parties shall treat confidential materials as confidential. A.L.I.C.E. can sign an NDA upon request. A.L.I.C.E. may disclose information only where required by law or court order.


3. Deliverables

Report (Report.pdf). The Report includes: an executive summary; case overview (platforms and scope); evidence summary table (URLs, UTC timestamps, identifiers, metadata); behavior analysis; informational impact estimates; relevant platform/policy notes; suggested non-legal actions; and a methodology disclosure (capture tools, folder structure, hash method).

Evidence Package (Evidence/). Full-resolution evidence files (e.g., IMG001.png, IMG002.png) are delivered in original form. A hashes.csv file contains SHA-256 hashes, UTC timestamps, metadata, and analyst notes.

Signed Evidence Verification Statement. Includes capture methods, UTC timestamps, SHA-256 hashes (where applicable), custodian information, and confirmation of non-tampering.

Chain of Custody. Documentation includes collector identity, capture timestamp (UTC), platform and content ID, storage method (investigator-controlled encrypted workstation), hash verification steps, and delivery method.


4. Service Options & Pricing

One-Time Sweeps. Comprehensive one-time investigations quoted per project. Deliverables include Report.pdf, Evidence package, Methodology Disclosure, and Signed Evidence Verification Statement. Sweeps focus on major/high-priority items and do not guarantee exhaustive enumeration.

Retainer Monitoring Plans. Basic, Pro, and Enterprise tiers offer different platform coverage, reporting frequency, depth, and alert priority. Retainers are separate from sweeps; retainer clients receive discounted sweep pricing and priority scheduling.

Pricing Summary. Standard retainer pricing: Basic — €650/month; Pro — €1,500/month; Enterprise — €3,500/month base + €250 per extra platform. Sweep pricing is quoted individually based on scope and depth.

Payment Terms. One-time sweeps require a 20% deposit upon acceptance of the quote; the remaining 80% is due within 14 days after report delivery. Retainers are billed monthly in advance; annual payment options are available by agreement. Refunds for sweeps are available only prior to report delivery. Post-delivery modifications are permitted within seven (7) days: minor corrections are free; substantive changes or new scope will be quoted separately.

Turnaround. Standard turnaround is 3–14 business days from the agreed start date. If A.L.I.C.E. does not deliver within 21 calendar days without prior written agreement, the Client may request a refund for the affected service fee. Expedited work may be available for an additional fee.

Tax & Invoicing. Invoices are issued in EUR unless otherwise agreed. Under French auto-entrepreneur rules, VAT may not apply; where applicable, invoices will include: “TVA non applicable, art. 293 B du CGI”.


5. Privacy, Data Security & Retention

Storage & Transfer. All evidence is stored on an investigator-controlled, encrypted, password-protected workstation with no cloud syncing unless explicitly agreed. Delivery is via AES-256 encrypted ZIP or a secure password-protected link when necessary.

Data Protection. Personal data encountered during monitoring is handled in compliance with applicable laws (including GDPR where applicable) and platform policies. The Client is responsible for ensuring it has a lawful basis to request monitoring and to provide credentials.

Retention & Deletion. Evidence and reports are retained for six (6) months by default. Custom retention durations or early deletion can be requested, subject to contractual obligations.

NDAs. Non-disclosure agreements can be signed upon request.


6. Warranties, Disclaimers & Limitations

ALL SERVICES AND DELIVERABLES ARE PROVIDED ON A BEST-EFFORT BASIS AND “AS IS.” A.L.I.C.E. MAKES NO GUARANTEE OF SPECIFIC OUTCOMES.

  • A.L.I.C.E. does not guarantee detection of all instances of infringement or that any platform will act on the evidence.
  • A.L.I.C.E. does not provide legal advice or legal determinations. Clients should consult qualified legal counsel before taking enforcement actions.
  • A.L.I.C.E. does not warrant admissibility of evidence in any jurisdiction; admissibility depends on applicable rules and independent counsel review.
  • A.L.I.C.E. is not responsible for downstream decisions or enforcement actions made by the Client or third parties.

Limitation of Liability. A.L.I.C.E.’s total liability is limited to the fees paid for the specific Report or Service giving rise to the claim. A.L.I.C.E. is not liable for indirect, incidental, special, punitive, or consequential damages.

Insurance. Professional indemnity insurance is available upon request.


7. Investigator Model & Operational Notes

A.L.I.C.E. operates as a dedicated single-investigator service. All findings are personally collected, verified, and documented to maintain consistency and a clear chain of custody. Large-scale or high-volume cases may require extended timelines, which will be specified in the engagement quote.


8. Termination & Suspension

Either party may terminate for material breach after providing 14 days’ written notice to cure. A.L.I.C.E. may suspend Services immediately for non-payment or if the Client requests actions that would be unlawful or violate platform Terms of Service. Evidence or reports may be withheld until overdue fees are paid.


9. Indemnification

The Client shall indemnify and hold harmless A.L.I.C.E. from third-party claims arising from the Client’s use of the Services, instructions to A.L.I.C.E., misuse or disclosure of evidence, or breach of these Terms.


10. Governing Law & Dispute Resolution

These Terms are governed by French law. Disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France, unless otherwise agreed in writing. Where translations exist, the English version controls unless required otherwise by law.


11. Amendments & Versioning

A.L.I.C.E. may update these Terms periodically. Material changes will be posted on the A.L.I.C.E. website and retained Clients will be notified. Continued use of the Services constitutes acceptance of updated Terms.


12. Acceptance

By instructing A.L.I.C.E., accepting a quote, paying an invoice, or otherwise using the Services, the Client confirms they have read, understood, and accepted these Terms and have authority to do so.
